Every female employee in Morocco is entitled to maternity leave, compensated by CNSS under certain affiliation conditions, separate from her annual paid leave.
Maternity leave is set at 14 weeks, generally split before and after childbirth, according to the terms set out in the Labor Code. This leave cannot be deducted from the employee's annual paid leave balance.
To receive maternity daily allowances, the employee must have a minimum period of CNSS affiliation and contribution (generally 54 consecutive days or 108 days during the 10 months preceding the expected delivery date).
The maternity daily allowance is calculated based on the average salary declared to CNSS in the months preceding the leave, paid for the full duration of the legal leave, up to the applicable CNSS cap.
The Moroccan Labor Code protects employees from dismissal during pregnancy and maternity leave, except in cases of serious misconduct unrelated to their condition, strictly regulated by law.
