Any hour worked beyond the legal working time (44h/week in industry and commerce) entitles the employee to a pay increase, at a rate that depends on when the hour is worked.
| Time slot | Working day | Weekly rest day |
|---|---|---|
| 6am — 9pm | +25% | +50% |
| 9pm — 6am (night) | +50% | +100% |
These are the exact same rates (+25%, +50%, +100%) our calculator uses to apply the correct increase depending on the situation.
Hourly rate = Monthly base salary ÷ legal monthly hours (191h for a 44h/week schedule). Overtime amount = Number of hours × Hourly rate × (1 + increase rate).
For a base salary of 8,000 MAD/month (191h), the hourly rate is about 41.88 MAD. For 5 overtime hours at a 25% increase: 5 × 41.88 × 1.25 ≈ 261.75 MAD, taxable and subject to contributions like the rest of the salary.
Yes, the Moroccan Labor Code generally caps overtime at an annual quota, beyond which authorization from the labor inspectorate is required. These hours should remain exceptional and not become the norm.
