In the event of a work incapacity justified by a medical certificate, a Moroccan employee no longer receives their usual salary from the employer, but may be entitled to daily allowances paid by CNSS, under certain conditions.
The employee must be affiliated with CNSS and have a minimum number of contribution days (generally 54 consecutive days or 108 days during the 6 months preceding the leave) to be entitled to sickness daily allowances.
Daily allowances are only paid starting from the 4th day of incapacity: the first 3 days of leave are, in principle, not compensated by CNSS, unless the employer provides more favorable terms.
The daily allowance is calculated based on the average daily salary declared to CNSS over recent months, generally at a rate of around two-thirds of this reference salary, up to the CNSS cap.
The law does not require the employer to top up CNSS allowances to maintain the full salary — but some employment contracts, collective agreements, or company practices provide for this. Any such top-up, when it exists, must appear on the payslip for the relevant month.
